Yeah - I will admit that I gave up on Palladium a long time before the Kickstarter began....

 

The Auld Grump - K. S. is a great example of a person that should never run a business....

 

My only surprise with this Kickstarter was that there were over 5,000 people willing to trust Kevin to the tune of $1.4m. As soon as I saw that Palladium was the creator I knew to stay well away from thjs.

IIRC, Ninja Division was touted as those responsible for the project, but, yep, good move.

 

I didn't back this one, but I learned from this project and AvP (and Fairy Tale Battle Royale) that you need to know -- and approve of -- all parties involved in the project before backing!

The Kickstarter lists Palladium Books as the creator. It doesn't get much simpler than that. They can try and pass the buck all they want, but it is their name listed as creator (which I assume also means they are the ones contractually responsible for ensuring backers get what they pledged for).

I know not everyone agrees with this view, but I've always considered Ninja Division a little bit sketchy themselves. They were doing the whole new name same people thing after Sodapop made a few blunders.

The man complained when White Wolf Magazine didn't carry any material for Palladium Games - simply because no one was submitting any - and they printed his letters - twice.

 

When they finally got a Palladium game submission, they gleefully went and told Siembeda that they had something!

 

And then he told them that no one but Palladium was allowed to publish anything for Palladium games....

 

That pretty much sums the man up in a nutshell.

 

The Auld Grump - the lawsuit against WotC was another gem.

I assume it is referring to the lawsuit over Palladium conversion rules in The Primal Order (pre-Hasbro WotC) that was settled out of court. Though Adkison (the author) has admitted in interviews that he had not really coordinated with other publishers about including components for their games, so some of them having a negative reaction wasn't entirely surprising.

What contract are you referring to? One between Kickstarter and Palladium? One between Palladium and Ninja Division? Something else? It's hard to tell as there is a lot of stuff on the DakkaDakka thread.

Unless you have a lawyer working for free on a crowdfunded project (and I've seen so for two KS, since the lawyer was a backer), the contract between backers and creator is essentially worthless, because it's going to cost you more to pay the lawyer than what you'll get from the creator. However, you might get a refund through your credit card company, though, last I heard, the longer the time between the charge and your claim, the harder it is to get your money back.

How many multi-million dollar Kickstarter projects have to fall over before someone decides to take a class action suit against Kickstarter itself though? I can see a lawyer taking up a case like that pro-bono to make a name for themselves.

That would kill the crowd funding movement and community. WE hold the creators responsible by commenting, choosing which projects to back and making sure other backers know which creators live up to their promisses. Holding KS responsible is like holding the car dealership accountable for your new car having warranty issues months after you buy it.

Or trying to hold the phone company liable for calls from a telemarketer.

 

Or a bank when somebody gives you a rubber check.

 

Kickstarter is a service - transactions go through them, but they are not the ones initiating the transactions, nor are they responsible for fulfilling the transaction.
