Kickstarter is a service - transactions go through them, but they are not the ones initiating the transactions, nor are they responsible for fulfilling the transaction.

They are taking a cut of the money projects receive though, so there is some liability on Kickstarter to ensure that the projects are fulfilled.

 

Similarly, your credit card company has a liability to protect you if your card is misused or a company does not provide the product or service your card was charged for (or at least they do in Australia).

Except that when you agree to Kickstarter's terms of service you agree effectively sign away the possibility of Kickstarter being liable for failed projects. Kickstarter currently lacks the regulations that credit card companies are subject to. There will likely eventually be a lawsuit, but it's goal will probably be to  draw attention and force new regulations rather than actually establish liability for Kickstarter.

For those in the bleachers, Palladium just admitted that there will never be a Wave 2.  In fact, Palladium did not renew the license for Robotech, so they must liquidate their entire Robotech stock (including the RPGs) by the end of March.

 

Backers can get remaining Wave 1 RRT stock in trade for Wave 2 items not received, but they must pay for shipping.

They'll probably be selling the remaining wave 1 stock at prices under what they're offering backers.

All the stuff I really wanted was in wave 2. Not sure if I want more wave 1 stuff, except maybe to take up Battletech again with the figures.

I knew it would be a mess going in, just figured that they would get it done eventually. Guess not.

The part that galls me is asking for CC info over KS message. That's not gonna happen.

There may be lawsuits, but I doubt that backers will ever see more than a few pennies on the dollar for their pledges.  Getting materials for a dead game may be the best deal that they will get even if they have to pay shipping.

 

Assuming that the backers win, Palladium could just declare bankruptcy.  I can’t imagine that they have the money to pay lawyers and pay any significant judgement.

So even though fulfilment isn't going to happen on this, I'm keeping this thread open as it looks like some folks are going to try for some kind of refund and hopefully info posted here will help them.

 

With that in mind I'm going to ask that forumites keep on topic when posting in this thread so that potentially helpful info can be more easily found.
