Riders on the Worm, Dune-inspired sticker

Young artist, first Kickstarter project. Seems to be well planned.

KS page doesn't say if s/he has the rights to make the stickers.

 

If it's anything like how Fantasy Flight Games tried to get the rights for the Dune boardgame (and didn't), s/he probably doesn't.

Way to go! Crush their spirit while they're still young and impressionable.  What do you think Herbert Properties will object to most? The use of copyright protected art, or the stunning likeness of the main character?  Or is it more of a "look and feel" violation with the sand worm?  You ought to write Universal Pictures, too, I believe they did a movie with a giant sand worm.

Couldn't care less about the movie. A gigantic yawnfest from start to end. 

 

Please note that the artist is already selling a previous version of the sticker, so is already making money off of someone else's property.   

 

Where do you draw the line?   

 

What if someone made 'collectible stickers' with pictures of the minis you've painted?    

 

Without asking first...

If she was using my photos, or my art, or anyone's art but her own, you'd have a point.  As far as I can tell she has not copied  anything except the concept of a person riding a giant sand worm. Concepts specifically cannot be protected by copyright. 

 

Thus my question, what do you think Herbert Properties is going to object to?

The fact that she's using the word 'Dune' and mentions the book specifically?    

 

And if they have something to complain about, it's way better that they say it now, rather than after the project has ended and money has been collected.    

 

She should have cleared this with either Herbert Properties or a lawyers specializing in this type of law, and written about it on the project description page. 

Lawyers and IP owners generally doesn't believe in the 'it's easier to get forgiveness than permission'... 

 

Our hobby is already suffering from IP theft. I it OK for us to look the other way when it happens to something outside our hobby?    

 

My final rant on this.

While I think it's unlikely she got permission, they've been more open to licensing recently. The Dune board game is even back in print now.

Whatever they and their lawyers can get away with, and whatever *they* think they need to do to protect their IP. Legality doesn't matter when it's "big vs. small". All "big" has to do is send a C&D letter if *they* think there's a reason (and sometimes even if there's not), then drag out court cases until "small" runs out of money. Sometimes "big" fails, such as GW vs. Chapterhouse, sometimes it doesn't, such as Mirmax's C&D against CMON, and some Nintendo (?) vs. a Legend of Zelda fan KS.

 

Regardless, delays are no good for a KS project, and backers usually have little recourse when a project runs out of money. OTOH, It's not like you're really losing money backing this KS.

I doubt they would care unless a lot of people make a fuss. Its a $400 fan project. I doubt they want to be seen as the bad guy and imo dont think shes "stealing" anything. Ive lost count of the games with big worms in it. :)

I just came in to say, when I saw the title of the post, the song "Riders on the Storm" by the Doors popped into my head, but with "Riders on the Worm" as the words.

Wait, isn't that the whole idea? I just assumed that was the reference, which is why I backed it without reading the page.
